韩国私立大学在借鉴世界高等教育发达国家办学经验的基础上，结合韩国高等教育的实际需要，形成了富有自身特色的现代大学制度模式，成为亚洲地区现代大学发展的典型。大学法人理事会对于保障高校及其附属机构做到“依法治教、依法治校”至关重要。国内高校应该在借鉴韩国私立大学法人理事会发展历程及运营模式的基础上，从法律层面上为高校建立大学理事会提供依据和保障，端正对理事会的认识，严格按照《高等教育法》和大学章程设立理事会。理事会成员构成务必应体现出开放性、代表性等特点，明确职责，严谨干涉学校事务正常运营。

The private universities in Republic of Korea is based on experience in developed countries of higher education, combined with the actual need of Korean higher education school, formed its own characteris?tic mode of modern university institution, and has become the typical development mode of modern university in Asia. University?s legal council is fundamental for ensuring college and its affiliates to “administering and law?ful”. Domestic colleges should provide development history and operation pattern to construct university?s legal council from a legal level. Correcting the understanding of the council and setting up the council in strict ac?cordance with the higher education law and the articles of association of the university. The composition of coun?cil members should embody the characteristics such as openness, representative, clarify the responsibility, and forbidden to interfere with the normal operation of school affairs.
