建设工程施工中对受害人赔偿的情形极为复杂。对建设工程施工单位与受害人之间关系进行类型化分析，是就受害人人身损害赔偿问题进行路径选择的前提。在建设工程施工单位与受害人之间存在合法用工关系的情形下，工伤保险赔偿请求权和人身损害赔偿请求权，在权利竞合方面采“兼得模式”，在赔偿数额方面采“补充模式”；在二者之间存在非法用工关系的情形下，受害人的人身损害赔偿问题，适用《非法用工单位伤亡人员的一次性赔偿办法》的规定；在二者之间不存在用工关系的情形下，受害人的人身损害赔偿问题，适用民事侵权损害赔偿的相关规定。
