环境和经济发展存在特殊的关系。国家在制定环境刑事政策时必须考虑经济性因素。多数学者致力于捍卫环境犯罪的刑事政策的独立性，倡导破除长久以来环境保护对经济发展的依赖关系，推崇扩张解释的方法、确立从严惩处的环境刑事政策，对现有罪名进行解释及适用。从环境犯罪的刑事政策的概念梳理出发，继而通过对其运行现状的阐述，以《刑法》第338条中对“严重污染环境”解释为视角对我国应当秉持环境犯罪的制裁思路与刑事政策进行定位，进而更好地运用刑事手段保护环境和资源。

There is a special relationship between the environment and economic development.The nation must consider e-conomic factors in the development of the environmental criminal policy.The author opposes the majority of scholars commit-ted to defending the independence of the criminal policy of environmental crime,and proposes to eliminating the dependence of environmental protection on economic development,promotes the interpretation method for expansion and establishing the envi-ronmental criminal policy with severe punishment,and explain and apply the existing accusations.This article reviews the con-cept of environmental crime of criminal policy from environment crimes,and then position the sanction thinking of environment crime and criminal policy by expounding its operation situation and taking Article 338 of"Criminal Law":"Serious Pollution of the Environment" as a perspective,hence using the criminal means to better protect the environment and resources.
