城市地下管网是城市的“生命线”，为城市生活提供必要保障，但是由于相关法律制度不健全，责任追究机制缺失，使得侵权事故层出不穷，屡禁不止，受害人求偿无门。在论证城市地下管网是公有公共设施的基础上提出将城市地下管网侵权纳入国家赔偿范围。公有公共设施侵权民事赔偿有其局限性，并且不利于控制和规范行政权力，而国家赔偿有国际先例，具有现实的借鉴意义，将城市地下管网纳入国家赔偿不仅能更好地规范行政权力，同时也能快速高效地实现受害人的权益。

Urban underground pipelines are taken as the "lifeline"of the city , which provides the guarantee for city life . Because of the related legal system is not sound and the lack of responsibility mechanism , the victim of infringement can't get compensation .The problem damaged by the underground pipelines are should be brought into the scope of state compensation .The civil compensation of public utilities infringement can not be controlled by the administrative power and there are some cases of state compensation in the world .It can not only better regulate the administrative power of state , also can realize the victim's rights and interests.
