集合资金信托由于极富弹性的法律构造，在我国的信托市场中所占比重及影响力不断扩大。但在集合资金信托计划的运作过程中，由于我国信托文化的缺失及法律规范的不完备，信托公司道德风险频发，严重扰乱我国信托市场秩序，也给信托投资者的合法权益造成严重损害。我国应在强化集合资金信托受托人义务理念的指导下，通过强化信托公司勤勉注意义务、加强违规关联交易规范、细化信息披露义务三个方面对信托公司的道德风险予以规制。

Due to the specific legal regulation of assembled funds trust , Chinese assembled funds trust market and its influence continues to expand .But in the course of the operation of the fund , the rights of the trust investors has been damaged seriously be-cause of the lacking of the trust cultural tradition in China and the moral hazard of the trust company .It is necessary for us to strengthen the obligation of the trustee , regulate the illegal related transactions , and the disclosure of the information in order ot pre-vent the moral hazard of the trust company .
