延伸性集体许可机制能够很好地贯彻尊重私权、私人自治的理念，同时还能在一定程度上缓解孤儿作品的困境。虽然延伸性集体许可制度在北欧五国有成功应用的经验，但我国实施该制度的基础薄弱。因此，构建我国延伸性集体许可机制，宜采取谨慎的态度，尤其在对非会员权利人的保护方面，实现权利人、使用者与产业三者利益的平衡发展。
延伸性集體許可機製能夠很好地貫徹尊重私權、私人自治的理唸，同時還能在一定程度上緩解孤兒作品的睏境。雖然延伸性集體許可製度在北歐五國有成功應用的經驗，但我國實施該製度的基礎薄弱。因此，構建我國延伸性集體許可機製，宜採取謹慎的態度，尤其在對非會員權利人的保護方麵，實現權利人、使用者與產業三者利益的平衡髮展。

The extended collective licensing mechanism can effectively implement the notion of respect for private property and private governance, also it can ease the plight of the orphan works to a certain extent. Although the extended collective licensing mechanism has successful cases of application in the Nordic coun-tries, basis for the implementation of the system in China is weak.Therefore, the extended collective licen-sing mechanism should be emphasized, especially in the protection of the rights of the non members, in or-der to realize balance of interests of the rights holders, users and industry.
