作为一项体现劳动者人格独立、蕴含劳动者利益的基本人权，休息权是我国宪法予以确立的劳动者的基本权利之一。我国多部法律法规都对休息权做出了明确规定，规范休息权的框架已基本形成但尚未落到实处。在现实中，劳动者的休息权正在遭受严重侵犯。本文通过对劳动者休息权法律保障进行梳理，指出问题所在并提出相关完善建议。

As a basic right which embodies personality independence of the laborer, and contains the interests of laborers, the right of rest is one of the labor's basic rights that have been established by our constitution. The labor's right of rest has all been explicitly stipulated, and its criteria have been fundamentally formed, yet still hasn't been earnestly implemented. The labor's right of rest in our country is severely suffering from deprivation. Based on the analyzing of the current situation, the author point out the existing problems and put forward her views in designing the legal security systems for the labor's right of rest in China.
