香港基本法的解释权属于全国人大常委会，同时全国人大常委会授权香港法院解释基本法。《基本法》的解释充满了解释主体、解释体制、解释技术和方法各方面的矛盾和冲突。全国人大常委会按原意方法解释基本法，特区法院按照其普通法传统解释基本法，从而导致解释结果的差异性，全国人大常委会和特区法院解释方法的不同与其所处的体制并非简单对应关系，两者从技术层面仍有较大空间化解因释法方法的差异性引发的冲突。现阶段基本法解释的冲突协调依赖于基本法解释的基础制度构造，主要体现为特区法院自身的司法建设和全国人大常委会解释基本法程序规则的完善。

The power of interpretation of Hong Kong Basic Law belongs to the Standing Committee of the Nation People’s Congress(NPCSC),and the NPCSC will authorise the HK courts to interpret Hong Kong Basic Law,according to the Article 158 of the Hong Kong Basic Law. While,when the Basic Law needs to be interpreted,lots of conflict have been coming,because the NPCSC prefers originalism interpretation method, and HK courts prefer the common law tradition method. However,from technical perspective,there is still much space for them to resolve conflicts caused by different interpreting methods. Coordination of conflicts in the interpretation of Basic Law depends on the basic system construction of Basic Law interpretation,mainly for judicial construction of HK courts and improvement of proceeding rules of the NPCSC interpreting Basic Law.
