亲亲相隐制度在我国有着悠久的历史，从西汉一直到清代，延续了两千多年，对于维护封建统治秩序发挥了积极作用。该项制度有着深刻的价值意蕴，首要的是法律的人文关怀，即承认人的恻隐之心。其次是刑法谦抑性的体现，具体指对国家刑罚权的限制。同时，该项制度基于对家庭这一社会细胞的保护，有利于维护稳定和互相信任的社会关系；亲亲相隐制度与基本伦理道德相契合，也有利于人们对法律的自觉遵守与执行，维护法律的权威。亲亲相隐制度的价值与现实意义应充分发掘，在现行的《刑事诉讼法》中，应赋予近亲属免证特权；《刑法》中包庇、窝藏之类的犯罪，应根据法定刑的轻重相应地免除或减轻刑事责任。

Kin Concealment system in China has a long history,from the Western Han Dynasty to the Qing Dynasty lasted for over two thousand years.It has played a positive role for the maintenance of the rule of the feudal order.The system has a profound value of implication that firstly is the humanistic solici-tude,namely admit one’s sympathy,of law.Secondly,it is a manifestation of the restraining criminal law, specifically referring to the national penalty power’s limits.At the same time,the system of protection of the family benefits the maintenance of social stability and the reliability;and the conj unction of ethics makes the observation and execution of law consciously,maintaining the authority of the law.The value of Kin Concealment system and practical meanings should be fully utilized.In current Criminal Procedure Law should give relatives the privilege of testimony;in Criminal Law such crimes as harboring and sheltering of punishments should reduce criminal responsibility according to law.
