非法证据排除规则中的非法证据是狭义上的非法证据，即通过违法手段获得的证据。这种非法证据大多都具有关联性，也可能具有客观性。但无论非法证据是否具有客观性和关联性都应当予以排除，既不能作为最终裁决的依据，也不能作为各个诉讼程序节点的依据。非法证据的排除范围从证据存在形态上和表现形式上，可以归纳为非法言词证据和非法实物证据。言词证据一旦被认定为非法证据就应在各个诉讼环节予以排除。非法实物证据排除的对象应作广义理解，不仅仅包括书证、物证，其他如视听资料、电子数据等被界定为非法证据的也应排除。实物证据分为合法证据、瑕疵证据和非法证据。其中瑕疵证据有两个走向，能够补正或作出合理解释的转化为可用证据，否则转化为应当排除的非法证据。
