对我国走私刑事立法的宪法考察，是着眼于全面有效实施宪法的需要，注重的是宪法确立基准的实现，是宪法的原则、规则和概念在法实践中的落实的一种衡量，不仅要依据宪法的规定或精神对有关法规范性文件和参与到走私罪惩罚机制中来的各国家机关或部门实施上述法律的具体行为方式作出评价，还要按宪法的规定和精神相应提出完善或改革的意见。依据宪法，走私罪的刑罚创制和量刑，应由全国人大或其常委会以法律形式规定，如果法律缺乏规定或规定得太不具体，就会留下权力旁落的隐患。刑法中的刑罚和量刑涉及到犯罪嫌疑人或被告人的基本权利，依我国宪法规定不能由最高国家权力机关之外的主体和法律之外的形式来创设，创制和施行新的刑罚标准必须以符合宪法的方式进行。

To perceive our criminal legislation on smuggling from the Constitution is based on the need of the full implementation of the Constitution. On one hand, it makes evaluation on the rules and regulations formulated in light of the provisions or spirit of the Constitution and on the specific conducts of the national authorities involved in the punitive mechanism for the smuggling crime in the implementa-tion of aforesaid laws. On the other hand, it presents accordingly the recommendations on improvement or reform according to the provisions and spirit of the Constitution. The establishment and measurement of the criminal penalty on smuggling crime should be provided in a legal form by the People’ s Congress or its Standing Committee in accordance with the Constitution. The establishment of the criminal penalty shall not be performed by the entity other than the supreme national authority and in a form other than law according to our Constitution. The new criteria of criminal penalty shall be established and imple-mented in a way complying with the Constitution.
