随着经济的发展、社会的变迁，农村宅基地流转已经以多种方式呈现出来。农村宅基地使用权流转存在的主要问题：一是法律规定存在矛盾的情况；二是没有法律保障的私下交易很活跃，存在很多权益隐患；三是有多占宅基地、浪费土地的情况，宅基地管理没有统一有效的规章。为了既保障农民宅基地权益，又有效促进宅基地使用权流转，需要国家和地方出台统一明确的法律规定，对农村宅基地实行全国统一登记制度，建立完善的转让规范程序，使农村宅基地使用权合法流转。

Along with the economic development and social changes ,the rural homestead transfer has been shown in different ways .The main problems with use right transfer of rural homestead are:One ,there is the conflict of law ;Two , private transactions without legal protection are very active and there are some possibilities of hidden rights and interests;Three ,there exists excessive homestead or a waste of homestead and homestead management has no unified rules and reg-ulations .In order to protect the farmers’ interests of homestead and promote the circulation of their homestead effectively , it is necessary for the government and local authorities to lay down unified and distinct laws and regulations ,have a uni-fied registration system in our country and establish perfect transfer procedure in order to transfer the use right of rural homestead legally .
