伴随信息时代科技的飞速发展，网络证据开始广泛涌现，网络非法证据排除规则也日益具备实际价值。网络非法证据排除规则建构的必要性在于信息社会网络证据运用日益广泛，网络证据很难根据传统非法证据排除规则实施可采性评断。对于网络非法证据排除规则具体建构设计，可从基本指导原则、排除范围、提出主体、具体程序、证明责任与证明标准、除外范畴六方面着手。
伴隨信息時代科技的飛速髮展，網絡證據開始廣汎湧現，網絡非法證據排除規則也日益具備實際價值。網絡非法證據排除規則建構的必要性在于信息社會網絡證據運用日益廣汎，網絡證據很難根據傳統非法證據排除規則實施可採性評斷。對于網絡非法證據排除規則具體建構設計，可從基本指導原則、排除範圍、提齣主體、具體程序、證明責任與證明標準、除外範疇六方麵著手。
반수신식시대과기적비속발전，망락증거개시엄범용현，망락비법증거배제규칙야일익구비실제개치。망락비법증거배제규칙건구적필요성재우신식사회망락증거운용일익엄범，망락증거흔난근거전통비법증거배제규칙실시가채성평단。대우망락비법증거배제규칙구체건구설계，가종기본지도원칙、배제범위、제출주체、구체정서、증명책임여증명표준、제외범주륙방면착수。
With the rapid development of the technology in information era,the network evidence is emerging widely,the exclusionary rule of network illegally obtained evidence also has the practical value. The reasons why internet exclusionary rule of illegally obtained evidence should be constructed lie in the fact that internet evidences are applied more and more widely in the information era,it is difficult to implement admissibility judgment for the network evidence according to the traditional exclusionary rule of illegal evidence. For the concrete construction of the internet exclusionary rule of illegally obtained evidence,it can be designed from six aspects including the basic guide principle,exclusion of scopes,presentation of the subjects,concrete procedure,prove liability and standard, the exception scopes.
