卫生标准包含了国家卫生计生的方针、政策、法律、法规、规章等相关内容，是一类专业性较强的、涉及人类健康和生命安全的标准，在卫生计生决策和保障公众健康方面发挥着重要作用。然而，从现有的卫生标准研究中发现，学术界偏向于介绍现有的标准体系，缺少在法学视野下对卫生标准法律效力及法律地位的研究。卫生标准包含国家标准、行业标准和地方标准。同时又分为强制性标准和推荐性标准。作者从卫生标准的概况、定义、分类、效力等方面出发，主要以强制性国家卫生标准为研究对象，来进一步探讨卫生标准的法律属性和法律地位问题，正确认识不同卫生标准的效力，以达到宣贯卫生标准的目的。

Hygiene standards include national health planning principles,policies,laws,rules,regulations and other related content,they are classes of highly professional standards relate to human health and life safety which play an important role in health planning decisions and protect public health. However,from the existing health standard study,we found that academics tend to introduce the existing standards,but lack of research on the health standards and the legal status of legal effect under the law perspective. Hygiene standards include national standards,industry standards and local standards. At the same time,it divided into mandatory standards and voluntary standards. On the profile in terms of health standards,definitions,classifications, effectiveness and other starting mainly in mandatory national health standards for the study,to further explore the health standard legal property and legal status,a correct understanding of the effectiveness of different health standards in order to achieve publicizing health standards purposes.
