权利和义务是法治建设的基石和核心内容，依照新时期法治要求，优化装备采购权利义务配置，对于推进装备采购法治化进程具有重要意义。总结了当前装备采购权利义务配置的主要经验，并依照新时期法治要求审视了装备采购权利义务配置存在的问题，提出了立法固化装备采购具体权利和义务、契约固化装备采购特性权利和义务、确立军方“特权”限制制度等采购权利义务配置的优化对策。

Rights and obligations are cornerstone and core content of legal system building.Ac-cording to requirements of rule of law in this new period,configuration optimization of rights and ob-ligations of equipment acquisition is important to promote the process of rule of law in equipment ac-quisition.The paper summarizes the main experiences and reviews the problems existing on configu-ration of rights and obligations of equipment acquisition in accordance with the requirements of the rule of law in the new period.The paper proposed optimization measures about configuration of rights and obligations of equipment acquisition,which solidify specific rights and obligations by legislation, and reinforce special rights and obligations of equipment acquisition by contract and establish system of military privilege restriction.
