共有人优先购买权制度是为了保护特殊主体利益而设计的，由于我国法律对共有人优先购买权规定比较模糊笼统，操作性不强，这一制度存在很多争议。针对共有人优先购买权制度的实际冲突问题，从共有人优先购买权在现实中存在的矛盾冲突入手，运用法经济学和逻辑分析的方法进行研究，以期能为共有人优先购买权制度的制订有所裨益。

The co-owner’ s preemptive right system is to protect the interests of the special subjects.There’ re lots of contraversies for this system because of its vague stipulations and deficient operability.In allusion to the pratical conflicts of this system, this paper uses the economics of law and logical analysis so as to offer some help for the formulation of this system.
