行政许可中止的适用条件主要包括被许可人的自身状况不再满足法定许可条件、被许可人不存在违法行为、行政许可中止维护的法益强于其所造成的公共利益的损失.行政许可中止与行政许可的撤销、变更、撤回、终止以及注销等类似法律概念存在界限模糊之处,应当对此加以严格区别.最小侵害原则以及行政规制理论明确了行政许可中止行为的正当性.为了在行政许可中止情境下保护被许可人的合法权益,那么中止许可的程序、相对人能否获得补偿以及许可恢复的模式等问题应当备受考虑.

Administrative licensing suspension's application condition includes the licensee's own situation no longer meets the legal permission conditions and the licensee does not implement illegal behavior and administrative license suspension to maintain the legal interests are stronger than the loss of public interests. Administrative license suspension and other similar legal concepts (such as repeal, alteration, revocation, termination and cancellation) are fuzzy, so strict distinction is very important. The principle of minimum infringement as well as administrative regulation theory has confirmed legitimacy of administrative license suspension. To protect licensee's legitimate rights in the administrative license suspension circumstances, then the procedure of suspended license, the other party's compensation and the mode of license recovery should be highly considered.
