我国地方立法的形成与发展、设区的市社会条件的变化表明，赋予设区的市地方立法权具有可行性和必要性。确保立法的差异性和针对性、增强法律制度对社会结构分化回应的及时性、注重立法"民主性"、发挥"立法"对改革的引领和推动作用应成为赋予设区的市地方立法权的法律思路。为了确保设区的市地方立法权有效行使，应完善相关法律，确立设区的市的立法主体地位；合理划分各级政府事权，明确设区的市立法权力的范围；增强立法的民主程度，提高立法质量，同时，还应注重对立法权行使的监督。

The formation and development of local legislation and the change of social conditions in the city divided into dis-tricts show that endowing the city divided into districts with the local legislative power by law is feasibility and necessity. En-suring the difference and pertinence of legislation, enhancing the timeliness of legal system responding to social structure de-construction, paying attention to democratic nature of legislation and playing a leading role by legislation in promoting the re-form should be the basic value orientations of the city divided into districts to exercise the local legislative power. In order to ensure the city divided into districts exercising the local legislative power effectively, we should make the city divided into districts posses the local legislative power by improving relevant laws, make the range of legislative power of the city divided into districts clear by the rational division of powers at all levels of government, improve the quality of legislation by enhanc-ing the degree of democracy legislation and pay attention to supervise the exercise of legislative power.
