以河南省为例分析，认为新《立法法》颁布前，市级地方立法权主体所制定的多为城市建设和管理、历史文化保护方面的地方性法规，没有出现扩张自身权力的倾向，但突出了更多城市对地方立法权的迫切需求。提出新《立法法》给地方扩权留下空间，并且没有明确“较大的市”之含义。《立法法》的修改使我国地方立法权面临的问题，从对立法主体资格的限制转为如何对地方立法权进行规制。未来市级立法主体的权力放开需要把握尺度，并且配套相应的制度架构。

Before the new Legislation Law was promulgated,what local municipal legislative body enacted in Henan Province were mostly local regulations involving urban construction and management,historical and cultural protection,and there was no tendency to expand the local power while highlighting the urgent needs of cities for more legislative power.The paper points out that the new Legislation Law leaves room for extending local power without clarifying the definition of "the larger cities".The modification of the new Legislation Law has changed the problems faced by China's local legislative power from legislative restrictions on the qualifica-tion of the local legislative power to how to regulate the local legislative power.In the years to come,the mu-nicipal legislative body needs to grasp the scale of power -releasing and should be equipped with the appropri-ate institutional framework.
