马克思主义法律理论的独特性在于它是“法律拜物教批判”，是批判自由主义政治哲学的法治理念及资本主义社会法治实践的法律理论，这是英国分析法学家柯林斯的基本结论，对于我们理解马克思主义法学的独特性以及把握它的当代价值具有启发意义。法律拜物教把法治看作为不可质疑的教义或必须信奉的原则，看作为国家的最优结构和终极理想，相信依靠法治，权力得到制约，权利得到保障，社会就会成为公平正义的社会。马克思主义法学不是停留在对法律表面功能的认同上，而是在历史唯物主义的视野下，从整体社会形态的宏观视角出发，以一种冷峻的眼光审视现代社会流行的法律理论、法律观念及法治实践，为法治进程的未来推进提供了独到的见解。

Hugh Collins thinks Marxist legal theory as “Criticism on Fetishism of Law”which criticizes the rule of law the-ory of the liberal political philosophy and the rule of law practice in the capitalist society,whose analysis has enlightening sig-nificance for the understanding of the uniqueness of Marxist jurisprudence and for grasping its contemporary value.The doctrine of fetishism of law reads the rule of law as undoubtful principles that have to believe in.It is believed that,with the rule of law, power is restricted and rights is guaranteed so that fairness and justice can be reached in the society.Marxist jurisprudence does not just stay on the surface identity of the law’s function.Instead,it inspects the popular legal theories,legal concept and the practice of the rule of law in modern society from the perspective of the historical materialism and the macro perspective of the overall social form,and provides an unique insight for the advancement of the rule of law in the future.
