我国刑法虽然对夫妻间的救助义务没有明文规定，但是在实践中，有过将夫妻间不阻止配偶自杀认定为不作为犯罪的实例，这显然与罪刑法定原则相悖，笔者由此展开对夫妻间阻止配偶一方自杀的义务的思考。

China's criminal law does not expressly provide the rescue obligations between husband and wife, but in practice, there are cases in which not preventing the suicide of the other side between husband and wife was not identified as a crime, which is obviously against the principle of conviction according to the law. Thus, the author carries out the thinking on the obliga-tion of preventing the suicide of the other side between husband and wife.
