2013年11月21日,最高人民法院出台的《关于建立健全防范刑事冤假错案工作机制的意见》中明确规定将疲劳审讯列为非法方法,将经其所得的供述予以排除.一年以来,许多学者对如何定义疲劳审讯进行了讨论,并提出了自己的意见,但对于在实践中如何操作却少有涉及.文章从对各家学者对疲劳审讯的定义分析出发,结合相关调查,试图在合理界定疲劳审讯的基础上,对实践中出现的与此相关的问题给出自己的建议.

The opinion about establishing the precaution of false and erroneous cases which the Supreme People's Court issued on November 21, 2013 stipulated that the confession via grueling trail is illegal and should be excluded. Since it issued, many scholars have argued how to define the grueling trail and proposed their own opinion. But few of them have discussed the problems involved practical transaction. This thesis is based on the views of the scholars, combines with research, to try to define reasonably and give suggestions to the practical transaction.
