前几年,"中国式"过马路沸沸扬扬,发生在红路灯下的各种违法行为,未见得真的是"中国式",但一定是"人类式",行为模式背后是思维模式,正如社会法学派庞德所言,决定人们思维和行为背后的动因是利益关系.从这一点看,将"法"与利益紧密挂钩,是公民守法的外部性动力来源.作为在外的社会规则,这是法律所应该予以关注的.
