按照刑法学界的通说,不作为的成立要满足三个条件:有作为义务,有条件履行作为义务,没有履行.本文以"以假枪冒充真枪上交"为例,以不作为的行为评价中的"对抗性"为立足点,分析何谓"没有履行",即何谓法所期待的行为.

According to the criminal law educational world said, the establishment of negative act to satisfy three conditions: be obliged, as have conditions to perform the duty of a failed to fulfill.
