随着市场经济的不断发展,新型的不正当竞争手段层出不穷,在损害着市场上其他主体的利益的同时,也对公平的竞争环境造成了极大的影响.当下一种新的不正当竞争行为正在悄然兴起并且对市场经济造成很大的危害性,即商标反向假冒行为.商标反向假冒行为是行为人在没有原商标权人同意的情况下,通过正当途径获得了粘贴有原商标标识的商品之后,更换或去掉原有商品的商标,之后再将带有新商标的商品投入市场进行流通.此种行为不仅仅侵犯了原产品商标持有人的利益,为其造成了经济损失,也侵犯了消费者的知情权,严重的影响了市场经济的健康发展.
