共犯的量刑平衡并不意味着可以依据和解共犯的部分和解行为对普通共犯进行从宽处罚，且将造成部分被告人“搭便车”的现象。限制从宽处罚的幅度便是一种相对务实的做法，但仍然面临认定上的障碍与适用上的混乱。从宽处理作为刑事和解的主要方式，已随恢复正义而被纳入刑事责任体系之中。量刑平衡是指兼以社会危害性与人身危险性为根据的量刑平衡，是多重目标价值的体现，其与对部分和解共犯的从宽处理并不存在根本上的冲突。

Sentencing equalization of joint crime does not lead to lenient punishment on overall accomplice, e-ven though some of them have reached a reconciliation with the victim;otherwise, it will make some of the defend-ants "free rider". Restrictive leniency is relatively pragmatic, but we still have to face the obstacles in its identifi-cation and application. Lenient punishment, as the main way of criminal reconciliation, has been incorporated into the criminal responsibility system along with restorative justice. Sentencing equalization means a balance based on the social harmfulness and personal dangers;it is reflected in the value of multiple objectives and has no fundamen-tal conflict with lenient punishment on partial accomplice who have reached a reconciliation with the victim.
