鉴于西方法治现代化的宗教维度以及宗教在西方法治现代化进程中的地位和作用，在西方法治现代化的视域下观照中国魏晋南北朝时期“沙门不敬王者论”可能具有的法治意义。分析认为，由于当时中国特定语境中强大的王权，东晋时可能形成王权对立面的教权终究未能给中国法治现代化的走向带来契机。
鑒于西方法治現代化的宗教維度以及宗教在西方法治現代化進程中的地位和作用，在西方法治現代化的視域下觀照中國魏晉南北朝時期“沙門不敬王者論”可能具有的法治意義。分析認為，由于噹時中國特定語境中彊大的王權，東晉時可能形成王權對立麵的教權終究未能給中國法治現代化的走嚮帶來契機。

In view of religious dimension of the western legal modernization as well as position and role of religion in development process of western legal modernization,it is possibly of legal significance to discuss "Theory of Salmonella Disrespect to the King" in dynasties of Wei,Jin,and Southern and Northern from the view of western legal modernization. It is concluded from the analysis that because of the powerful monarchy in Chinese special context at that time,magisterium which was liable to form opposite side to kingship in Eastern Jin Dynasty finally failed to bring opportunity to Chinese legal modernization.
