随着经济全球化的不断深入，各国法律制度也呈现出相互影响和包容的趋势，外国法律或判例在我国的司法审判适用也成了国家间司法交流与合作的重要内容。当需要将外国法律和判例作为我国司法审判指导规范适用时，一方面成立专门的法律翻译机关对法律内容进行查明，还原外国法律和判例应有的原则和精神；另一方面要对外国法律和判例进行实质性分析，明确适用的程序和标准。同时兼顾公共秩序保留原则，禁止法律规避，以维护国家司法权独立和统一。

With the deepening of economic globalization, the legal systems in different countries present a trend of mutual influence and inclusion. The application of foreign laws and cases in Chinese judicial trial has become important in judicial exchange and co-operation between countries. When in need of reference and application of foreign laws and cases, we should set up special legal translation agencies to determine the content of foreign laws, restore the principles and spirit which are required of the foreign laws and cases. On the other hand, our government should conduct a substantive analysis of foreign laws and cases, put forward the clear applicable procedures and standards, consider the reservation of public order and prohibit the evasion of law in order to achieve the national judicial independence and unification.
