WTO法是当今国际法体系中为数不多的硬法。但是，由于发达国家成员的主导和操纵，WTO法中特殊差别待遇规则始终没有摆脱“软法”的命运，不能给发达国家成员设定法律义务，导致发展中国家成员享受发达国家成员提供的特殊差别优惠待遇缺乏法律保障。实际上，“硬化”WTO法中的特殊差别待遇规则具有强有力的现代法理的支持，也是WTO法性质和宗旨的客观要求。发展中国家成员应该通过联盟的方式形成合力，采取有效的对策，迫使发达国家成员尽快使特殊差别待遇规则变为硬法，切实维护发展中国家的合法权益。

WTO law is one of the few hard laws in current international laws,however,due to its domi-nance and control of the developed country members,the WTO Special and Differential Treatment rules do not break away from beinga“Soft Law”,resulting in the failure to create legal obligations for the devel-oped country members and the loss of legal guarantee for the developing country members’benefits from the Special and Differential Treatment by the developed country members. Actually,the hardening of the WTO Special and Differential Treatment rules are justified strongly by the modern legal theories,and is also the objective requirement of the nature and purposes of the WTO law. Therefore,the developing country members should join force through coalitions to take correct measures to force the developed coun-try members to harden the rules quickly so as to protect the interests of the developing country members feasibly.
