武术作为中华优秀传统文化的全息缩影，在现代社会发展中存在着诸多问题，在列入国家非物质文化遗产名录之后，其法律保护则更加值得关注。厘清武术的本质与法律属性是研究的前提与基础，文章就武术本质的各种观点，关于武术的法律属性不同专业背景的学者以及立法层面均有不同的论述与观点等两方面，总结了现阶段的研究与实践成果，建议应从顶层设计上规范较为统一的界定和归属，这有助于推动武术的良性发展。

As the holographic epitome of Chinese traditional culture of wushu there are many problems in the development of modern society, included in the national intangible cultural heritage, the legal protection is more worthy of attention. To clarify the essence of Wushu and the legal attribute is the prerequisite and foundation of study in this paper, different views on the essence of wushu, the legal attribute of different professional backgrounds of the scholars and the legislative level have different views and discussion, summarizes the research and practice of the results at this stage, the standard should be the top-level design and definition belonging to a more unified, and promote the healthy development of wushu.
