市场经济中，企业间借贷行为十分普遍。他有利于解决中小企业融资困难的问题却在法律效力上一直未得到认可，衍生出的利息问题，资金来源以及变相借款合同的效力也悬而未决。尽管相关判例已经确立企业间借款合同并非当然无效，但有关法律仍没有明确规定其效力状态。只有理清企业间借款合同的效力如何认定，才能有效解决其衍生问题。

In the market economy,loan contract among enterprises is popular,because it is helpful to resolve the problem of fi-nancing difficulties of small companies,which has not been recognized.Although the relevant jurisprudence has confirmed that the effect of inter -enterprise loan contract is not enforceable obviously,the law still does not clearly define the status of its ef-fectiveness.We should find out how to judge the effectiveness of inter -enterprise loan contracts in order to solve the problem of financing difficulties and interest.
