目前，尽管我国正在大力推行“简政放权”，但无论是基于快递服务自身特点，还是基于当前阶段我国基本国情，均应坚持快递业务经营许可制度。邮政专营是一项独立的法律制度，并不具有市场准入性质，更不属于作为特殊市场准入制度之快递业务经营许可制度的组成部分。在许可条件上，考虑到对快递企业注册资本金进行宽松化改革并不符合目前我国快递市场实际需要，不应对注册资本金进行宽松化改革；尽管以降资方式支持民营快递企业的初衷值得肯定，但统一各类市场主体准入门槛的现行立法原则不能动摇，不应就此对民营快递企业倾斜；考虑到立法的科学性以及我国快递市场健康发展的需要，对许可裁量因素的规定既要坚定执行，又要进行一定程度的完善，而关于许可条件及申请程序的立法，应坚持平等与合理两个原则。

At present,though we are doing more to streamline administration and delegate more powers to lower-level government and to society,we should adhere to the verification system of the Express industry because of the characteristics of this industry and the current situation of China. Postal monopoly is an independent law system without the nature of market access;it is not one of the components of the verification system of the Express industry. Under the precondition of verification system,with the consideration that relaxing the requirement on registered capital is not suitable to our real requirement on the Express industry,we should not relax the requirement on registered capital;though reducing the registered capital can give more support to private Express enterprises,we should adhere to the principle of unifying the criteria of the market access and can not provide the Express industry with more preferential policy;with the consideration of the scientific nature of legislation and the healthy development of China’s Express industry,to some flexible factors,we should not only to adhere to the basic principle, but also further perfect that;but for the verification conditions and the application procedures,we should adhere to such two principles as equality and rationality.
