根据最新调查显示，我国现有60岁以上老年人约2亿，未来20年我国老年人口将进入快速增长期，到2050年老年人口将达到全国人口的三分之一。这一连串数字的背后，显示出我国社会老龄化程度的加深已经成为一个不可忽视的社会问题。更为甚者，影响到老年人的精神性权益的保障。本文以老年人精神性权益的具体内容为切入点，分析了老年人精神性权益法律保护的依据及其必要性，从而对我国老年人精神性权益立法提出完善和建议。

According to the latest survey, we can know that the number of the old people who are at the age of 60 or above in China has approximately reached 2 hundred million. In addition, the aging population in China will enter a rapid growth period over the next 20 years, therefore the aging population will nearly rise to a third of the national population in 2050. Behind this series of numbers, showing the degree of aging society in our country, it has become a social problem which can not be ignored. What is more, it influence the guar-antee of mental rights and interests of the elderly. Based on the specific content of the elderly spiritual rights, this paper analyzes the el-derly spiritual rights basis and the necessity of legal protection, thus improve and put forward some suggestions for the legislation of elderly spiritual rights in China.
