我国法律硕士从设置至今已经将近20年。法律硕士教育的培养目标和定位是职业化教育,培养复合型的实务型、应用型的法律人才。但是在实践中,存在教学方式的混沌性和模糊性,课程设置的实践性不足,职业定位过于理想化和脱离实际。造成中国法律硕士教育培养模式的实践性不足的表层原因是行政化的教育体制导致法学教育机构没有动力进行法律技能的实践性教学,深层原因是司法权行政化的运作方式以及律师市场尚未形成充分竞争、律师市场的不发达造成了法律实践训练的不必要性。未来在本科教育结束之后建立专门的司法考试、司法技能培训机构,通过这种机构发挥培养司法人员实践技能的能力或许是一条更加务实的道路。

아국법률석사종설치지금이경장근20년。법률석사교육적배양목표화정위시직업화교육,배양복합형적실무형、응용형적법률인재。단시재실천중,존재교학방식적혼돈성화모호성,과정설치적실천성불족,직업정위과우이상화화탈리실제。조성중국법률석사교육배양모식적실천성불족적표층원인시행정화적교육체제도치법학교육궤구몰유동력진행법률기능적실천성교학,심층원인시사법권행정화적운작방식이급률사시장상미형성충분경쟁、률사시장적불발체조성료법률실천훈련적불필요성。미래재본과교육결속지후건립전문적사법고시、사법기능배훈궤구,통과저충궤구발휘배양사법인원실천기능적능력혹허시일조경가무실적도로。
There has been 20 years for the establishment of Chinese LL .M.In order to be an applicable legal personal , the LL.M candidate should be got Professional training/Multi-discipline training and Legal Practical training .But, in the practice, there are some shortcomings , such as:confused teaching method/lack of practice of curriculum and the professional location is too i-dealism and out of practice .There are two reasons for lacking of legal practice in the cultivating model of LL .M in China, the sur-face reason is that the administrative education system leads to the legal education institutions have no any motivation to carry out the legal practical training , the deep reason is that it is unnecessary for the legal education institutions to carry out the legal practical training, because of the operation of administrative legal power /the lack of sufficient competition and less development of lawyer market.In the future, it is practical way to cultivate the bachelor degree students to obtain the legal practical skills and capacities by setting up the special training institution , such as, the institution for legal examination training /the institution of legal skill training , etc.
