由于责任保险的诉讼与和解过程牵扯到多方当事人的利益，本文通过不完全信息博弈方法研究原告雇佣律师在责任保险诉讼与和解过程中的信号作用，利用动态博弈树的方法研究律师在不同收费制度下的行为动机，分析两种不同收费制度分离均衡的存在性，并比较胜诉收费制与计时收费制的优劣。
由于責任保險的訴訟與和解過程牽扯到多方噹事人的利益，本文通過不完全信息博弈方法研究原告僱傭律師在責任保險訴訟與和解過程中的信號作用，利用動態博弈樹的方法研究律師在不同收費製度下的行為動機，分析兩種不同收費製度分離均衡的存在性，併比較勝訴收費製與計時收費製的優劣。

Because of the liability insurance litigation and reconciliation process involving the interests of the parties, based on the incomplete information game method, the paper studies the signaling role of liability insurance in the process of litigation and reconciliation;then by use of the method of dynamic game tree, it studies the behavior motivation under different lawyer charging systems, and analyzes the existence of two kinds of different charging system separation equilib-rium;at last, it compares the pros and cons about the contingency fee system and the hourly fee system.
