虐童事件的思想根源是出于保护论或厌恶论,原因是幼儿教师儿童权利观念缺失。法律不健全,操作性差;义务本位的传统文化;法律的教育作用不足是教师权利观念生成的阻碍因素。幼儿教师应确立保护意识、责任意识和儿童主体意识。法律知识的培育、通过实践积累法律情感是儿童权利观念生成的重要路径。

The root of thought on child abuse is out of protectionism or disgust .The reasons of child abuse are from kindergarten teachers’ poor awareness on child rights, unsound law system, poor operability of law and our traditional culture on obligation standard. The lack of legal education has hindered the teachers’ correct understanding of rights. Kindergarten teachers should improve their consciousness on protecting children, their sense of duty and child-centered sense. The article discusses two ways to form the concept of child rights, that is, strengthening legal education and accumulating legal emotion.
