根据当前我国承包商在海外施工的主要市场分布，分析了承包商的主流索赔模式。通过调查发现在实际操作中主流的两种索赔模式均存在一些缺陷，为承包商造成了无形的损失。在这样的情况下，以国际通用的 FIDIC 合同为基础，以提高索赔的效率和成功率为目的，提出兼顾理论可行性与实践可操作性的“二次索赔”法，将工期索赔压缩至工程竣工前112天，费用索赔分割为两次，第一次是施工过程中的索赔，第二次是和工期索赔一并提交的人员、设备闲置费用索赔。“二次索赔”法的核心思想为给业主留下良好印象的前提下进行索赔，并给出了专用条款的设计，以期提高中国公司在海外工程项目中的索赔成功率。

This article analyzes the main methods for claim adopted by Chinese contractors doing businesses in the major overseas markets. In accordance with our survey,we have found that the current two major claim methods have some disadvantages,causing invisible loss to the contractors. Against this background,this article puts forward a “two-stage claim” theory,which is based on the internationally recognized FIDIC contract conditions and aims to increase the efficiency and success rate. The claim for time is reduced to 112 days prior to the project completion date. The claim for cost is divided into two stages. The first stage is the claim during the construction and the second is cost claim for personnel and equipment idleness together with the claim for time. The main idea of the “two-stage claim” theory is to claim without leaving a bad impression on the employer,on the basis of which this article analyzes the design for the particular conditions with the aim of increasing the rate for successful claim by the Chinese contractors in the overseas projects.
