"行政行为"是行政法学的重要范畴,但其代表性质的研究却一直被忽视。虽然民法学界论及了董事、经理等人员的代表行为,但行政法学在这相通的方面则完全是空白。行政法学应予以借鉴,在阐述行政行为的代表属性时,引入代表行为概念,在此基础上推进行政表见代表制度的确立,由此更加明确行政机关工作人员公务行为的不同种类、性质、后果,区别对待,以促进依法行政。
