行政规划存在着广泛的创造空间。规划裁量与一般裁量之间既有联系又有区别。规划裁量一方面有其存在的必然性和合理性并对社会发挥广泛的能动作用,另一方面规划权又易于滥用而产生危害社会的消极作用。现实中,行政规划裁量存在严重的失范现象,表现为立法上缺乏统一性和确定性、程序上缺乏民主性和科学性、裁量过程缺乏监督审查机制。行政规划裁量的治理模式可以采用硬法与软法并举的混合规制模式。
