我国对侦查辨认程序的相关立法简陋,立法层级低,立法规范性差。通过立法明确界定侦查辨认结论的法律地位,在完善我国侦查辨认程序时,应当对侦查辨认结论设置相关配套的法律规定,确保非法获取的侦查辨认结论得到合理排除。增加侦查辨认的形式,完善侦查辨认规则体系,完善侦查辨认程序的权利保护机制,进行侦查辨认必须进行全程录音录像。
我國對偵查辨認程序的相關立法簡陋,立法層級低,立法規範性差。通過立法明確界定偵查辨認結論的法律地位,在完善我國偵查辨認程序時,應噹對偵查辨認結論設置相關配套的法律規定,確保非法穫取的偵查辨認結論得到閤理排除。增加偵查辨認的形式,完善偵查辨認規則體繫,完善偵查辨認程序的權利保護機製,進行偵查辨認必鬚進行全程錄音錄像。
