国际习惯的普遍的拘束力并非绝对的,在实践中,国家可以适用"坚持反对者学说",通过持续反对来排除某个正在形成的国家习惯的适用.适用该学说必须满足一些规则,例如反对必须在合理的时间内提出等等.该学说以"默示同意说"为理论基础,本文认为从该理论基础出发,该学说在一定程度上对各国维护本国主权和国家利益是有积极作用的.

It is well-known that international customary law is capable of creating universally binding rules. The rules that govern its formation allow states to gain an exemption from emerging norms of customary law, that is, Doctrine of Persistent Objector. The doctrine gives states an opportunity to avoid binding force of customary law by objecting to it. To invoke the doctrine some elements must be met. For example, the objection should be raised within a reasonable period. The force of the doctrine rests on the implied consent of states. Then it is good to states to protect their interest.
