"无罪推定"作为现代各国的刑事司法的一项基本原则,是人类文明发展的必然结果.现代司法理念中法律价值观的发展方向,是由"国家本位"、"义务本位"向着"个体本位"、"权利本位"前进的,体现在刑事司法中,其追求的目标是以"人体公正"为中心的司法公正."无罪推定"原则,以保护犯罪嫌疑人、被告人在刑事诉讼中的合法权利为核心,以人权保障为理念,反映了现代司法现念的价值取向."无罪推定"原则,首先确立了犯罪嫌疑人、被告人在刑事诉讼中的主体地位,为其各项权利的实现奠定了基础,"控方承担举证责任"、"反对强迫自证其罪"、"非法证据排除"、"疑罪从无"等规则,是"无罪推定"原则的衍生物,是犯罪嫌疑人、被告人诉讼权利得以全面实现的必要保障,同时,也是对抗制诉讼模式的必然要求.

As one of the basic principles of criminal judicature of various countries in modem times, non-criminal inference is a necessary result of human civilization development . The legal values of modern juridical theory and concept are developing form national standard and duty standard forward to individual standard and ringhts standard. Embodied in criminal judicature, their aim is juridical fair of which individual just is the heart. Taking suspects＇ and defendants＇ legal rights protection as kernel in criminal lawsuits, taking human ringhts safeguard as thory concept, the principle of non - criminal inference reflects the value- taking of nodern juridical comcepts. Non- criminal inference principle takes the first step to establish criminal suspects＇ and defendants＇ main body position in criminal lawsuits, building the foundation for the realization of their various rights . The principles of accusers having the responsibility to supply evidences,opposing the coersion of self- proving crime,illegal evidence elimination, considering suspects as being not criminal and so on are the derivatives of the principle of non - criminal inference,the essential safeguard of complete realization of suspects＇ and defendants＇ various rights in lawsuits and meantime the necessary demands of opposing lawsuits mode .
