从告知义务法理依据分析入手,论证其法理依据应为诚实信用原则,从分析人身保险合同告知义务的履行主体、内容、途径出发,提出人身保险合同中告知义务人还应包含被保险人,其履行内容中应列明告知之重要事项,履行途径上应采用书面询问主义立法形式.从分析违反告知义务的主客观构成出发,提出违反告知义务的判断标准应以区分未告知事项与保险事故发生是否存在因果关系为基础.对违反如实告知义务的法律后果的制定要以平衡保险人和被保险人之间的利益为基本原则,提出对保险人行使合同解除权的前提加以一定限制.

According to the analysis of the representation obligation,the thesis deals with the principle of good faith and the principle of the freedom of contract in Insurance Law. Performing the representation obligation in the insurance contract will protect not only the interest of Insurer Underwriter but also the Applicant, especially in Personal Insurance Contract. The representation obligation should be based on the principle of good faith by the method of Jurisprudence. The Insured should be under the representation obligation in Personal Insurance Contract. The obligation of the Insurer Underwriter should draw lessons from Applicant＇s. Insurance Law should be perfected in the content and the way of performing the representation obligation in China. As the consequence of violating the obligation, Insurance Law should balance the interest between the Insurer Underwriter and the Insured.
