成文法的出现，是人类追求法律安全价值的努力，近代的法典法是将安全价值追求到底的尝试，历史证伪了成文法万能的思想。民法基本原则作为克服成文法局限性的工具被人类所认识，经历了一段漫长的时期。民法基本原则作为解释准则、法律补充规则的功能早已为学者公认，对其能否作为直接裁判依据则存在不同看法。原则的直接司法适用，是更高层次的“依法审判”，是法官在法律秩序框架内的创造性司法。本文结合司法实践中的案例，论证了民法基本原则直接司法适用的必要性、可行性，提出了司法过程中法官应遵循的程序作业和实体考量的建议。

The appearance of the written law is the efforts that the mankind pursues the safe value of the law, and the modern code law is the attempt that the mankind pursues the safe value thoroughly. However, the history falsifies the omnipotence of the written law. The basic principle of civil law that is known by the mankind as the tool overcoming the limitation of written law has gone through a long period.The basic principle of civil law is accepted generally by the scholar as the function of interpretation criterion and law supplemental rule early, but there are different views for whether it can act directly as the basis of judge. The direct judicial application of principle is more high-level “try in accordance with the law”, which is judge＇s creative judicature in the legal order frame. The article has proved the necessity and feasibility of the judicial application of the basic principle of civil law according to the case in the judicial practice, and has put forward the suggestions on the procedure and entity that the judge should follow in judicial course.
