按照经济分析法学的法律目的观，婚姻效力制度应当符合效率的要求。我国婚姻制度将重婚和近亲结婚规定为无效婚姻是契合婚姻效率要求的，但完全不承认事实婚姻和同居的法律效力、把惠有医学上认为不应当结婚的疾病和未达到法定婚龄的一概设置为无效婚姻则是非效率的。因此，有必要对我国婚姻效力制度进行修改。
按照經濟分析法學的法律目的觀，婚姻效力製度應噹符閤效率的要求。我國婚姻製度將重婚和近親結婚規定為無效婚姻是契閤婚姻效率要求的，但完全不承認事實婚姻和同居的法律效力、把惠有醫學上認為不應噹結婚的疾病和未達到法定婚齡的一概設置為無效婚姻則是非效率的。因此，有必要對我國婚姻效力製度進行脩改。
안조경제분석법학적법률목적관，혼인효력제도응당부합효솔적요구。아국혼인제도장중혼화근친결혼규정위무효혼인시계합혼인효솔요구적，단완전불승인사실혼인화동거적법률효력、파혜유의학상인위불응당결혼적질병화미체도법정혼령적일개설치위무효혼인칙시비효솔적。인차，유필요대아국혼인효력제도진행수개。
According to the legal purpose view of law science of economic analysis, the system that the marriage is effective or invalid should accord with the demands for efficiency. Of our country marriage system, the regulation that it stipulates bigamy and consanguineous marriage as the void marriage accords with the demands for marriage efficiency. But the other regulation, the one, not acknowledging the legal effect of the fact marriage and living together at all, is not efficiency. So is the one forbidding the person suffering from the disease thought not to get married in medical science and having not reached legally marriageable age to get married without exception. So, it is necessary to revise the system that the marriage is effective or invalid.
