《道路交通安全法》和已公布的《机动车强制保险条例》，在交通事故的处理程序和交通事故损害赔偿方面创设了一些新制度．在交通事故损害赔偿的责任主体和交通事故损害赔偿案件类型的变化．直接引起了此类案件诉讼程序的变化。我国现行的相关民事诉讼制度已不适应新型案件相关实体法律关系的规定．使得新型案件在正当当事人、共同诉讼（合并审理）的判定上缺乏诉讼技术上的支撑。对那些可能对本案的诉讼标的有“合一确定”必要的当事人参与本案时缺乏法律依据．限制了当事人行使诉权。在司法实践中，对交通事故损害赔偿案件当事人的诉讼地位和是否合并审理产生不同认识，也引起执法标准不一。机动车强制车险涉及公共安全和社会利益，其所涉及的主体范围很广，解决以上问题的重要性和紧迫性．不言而喻。

＂Road Traffic Safety Laws＂and ＂Provisions of Vehicle Forced Insurance＂have created some new systems in dealing with traffic accidents proceedings and compensation for damages. The subject of liability and the change of various cases in traffic accidents compensation for damages can influence directly on the change of proceedings. However, the present relevant civil proceedings in China have not adapt to the related regulations of the new cases, therefore, there is little support on the judgment of the just party and co-litigation in the new cases. The party＇s right will be restrained because of lack of legal bases. It also arises disputes on the party＇s status and whether or not combine in trials in dealing with traffic accidents compensation for damages. At the same time, the vehicles forced insurance is concerned with public security and social benefits. The body scale of it is very broad, so it is very urgent and important to solve these problems.
