作为国家享有所有权的城市土地和私权主体享有所有权的城市房屋,在出让、拆迁行为中都大量适用民法调整,公权力不应逾越界限。我国征地拆迁补偿含有强烈的民法因素,司法救济中应尊重民事权益,适用民法救济。

The Civil Law in most cases is applicable to the sales of the state-owned urban land and the removal of private property . The public power should not exceed its limits. There are obvious elements of civil law in the compensation and judicial relief of land collection and property removal in our country. Therefore, the civil rights should be respected and judicial relief applied.
