目前，国内高校校名主要依据《中华人民共和国民法通则》享有名称权保护。与企业名称保护相比，由于缺少专门的法律法规等原因，高校校名实际享有的名称权保护很有限。而且，随着我国社会主义市场经济的深入发展．高校校名在社会生活的多个领域凸现着重要的标识作用，因而，高校校名的商标属性日益明显。根据中国当前的国情，高校校名的商标权保护可从以下三方面入手：适用使用在先原则、保护范围扩大为全社会和知名高校校名实行品牌化保护。
목전，국내고교교명주요의거《중화인민공화국민법통칙》향유명칭권보호。여기업명칭보호상비，유우결소전문적법율법규등원인，고교교명실제향유적명칭권보호흔유한。이차，수착아국사회주의시장경제적심입발전．고교교명재사회생활적다개영역철현착중요적표식작용，인이，고교교명적상표속성일익명현。근거중국당전적국정，고교교명적상표권보호가종이하삼방면입수：괄용사용재선원칙、보호범위확대위전사회화지명고교교명실행품패화보호。
At present, the name right of colleges and universities is protected according to China＇s general rule of the civil law. Compared with the protection of enterprise＇s name, the name protection of colleges and universities is limited due to the lack of specific laws. With the further development of Chinese socialist market economy, the names of colleges and universities have become important marks in many fields and thus school names have demonstrated a more apparent quality of trademarks. Based on China＇s current situation, the paper suggests that the trademark right of colleges and universities should be protected from three aspects： the principle of first to use should be implemented; the scope of protection should be broadened to the whole society; and names of famous colleges and universities should be protected as brand names
