《物权法》的颁布实施对我国林业改革与发展将产生重大影响。分析了《物权法》对林业改革提供的法律保障、对林业发展提供的新的空间，并对《物权法》实施后林业部门应着重考虑的问题进行了初步探讨。指出特殊林木的范围及延长期限有待明确，森林、林木和林地统一登记后林权证的法律地位，由谁代表国家履行国有林业企业出资人职责，享有出资人权益需进一步明确；尽快研究征占用集体林地的林地补偿费标准。

The promulgation and implementation of ＂Property Law＂ to China＇s forestry reforms and development win have a significant impact. This paper analyzes the ＂property law＂ of forestry reforms to the legal protection of the new space of forestry development, as wen as what should forestry sector first focus on after the implementation of ＂property law＂. It holds that the scope and extension of the time limit of special trees to be clear, legal status of forestry ownership card after the unified registration of forests, trees and woodlands, who should represent the state in performing the duties of investors of state-owned forestry enterprises and enjoy the rights and interests of investor needs to be further clear; Levy occupation as soon as possible collective woodland woodland compensation standards.
