随着《人民法院第二个五年指导纲要（2004-2008）》的公布,有中国特色案例指导制度的建立正式提上司法改革的日程。在行政诉讼领域建立案例指导制度有深厚的理论基础和实际需要,分析行政诉讼案例指导制度的价值和缺陷,有利于针对行政诉讼的特点,建立健全行政诉讼案例指导制度,完善行政诉讼立法。
隨著《人民法院第二箇五年指導綱要（2004-2008）》的公佈,有中國特色案例指導製度的建立正式提上司法改革的日程。在行政訴訟領域建立案例指導製度有深厚的理論基礎和實際需要,分析行政訴訟案例指導製度的價值和缺陷,有利于針對行政訴訟的特點,建立健全行政訴訟案例指導製度,完善行政訴訟立法。

As the promulgated of ＂People＇s Court of the Second five-year Guidance Outline （2004-2008）＂, the ease with Chinese characteristics guidance system was set up formally on the agenda of judicial reform. There is a strong theoretical basis and actual need to establish this system in the area of administrative litigation. It is useful to analyse its value and shortcomings for the establishment of administrative litigation eases guiding system and the perfection of administrative litigation law.
